The following terms of use govern interactions with users of training seminars, consulting engagements, products, and other services provided by Nan McKay and Associates, Inc., doing business as NMA, a C corporation with its headquarters in El Cajon, California.

In these terms of use, “we,” “us,” and “NMA” refer to Nan McKay and Associates, Inc. “You,” “purchasing agency,” and “student” refer to the user.

NMA reserves the right to change any policies, Terms of Use, or pricing at any time and at our sole discretion. Your continued use of NMA’s products after changes are posted constitutes acceptance of the updated Terms of Use.

General Disclaimer

Our industry experts and consultants strive to design NMA products, services, and trainings with the most accurate, authoritative, and up-to-date information regarding the subject matter covered. NMA’s products, services, and trainings are provided “as is” without warranties of any kind, either express or implied. We do not guarantee the accuracy, reliability, or suitability of any content. Except as described below (“Limited Permitted Outside Agency Uses”), you may not reprint, copy, share, forward, post online, or distribute in any way NMA’s Products to any person or entity outside the purchasing agency, including with outside entities or subsidiaries or affiliated agencies, without the express written permission of Nan McKay and Associates, Inc. Reproduction or translation of any part of our products beyond that permitted by Section 107 or 108 of the 1976 United States Copyright Act without the permission of NMA, the copyright owner, is unlawful.

Limited Permitted Modifications and Sharing

The purchasing agency may modify only the NMA’s Model Policies and Guide Products, Model Forms, and no other Products.

Model Policies: The Purchasing Agency may modify NMA Model Policies and Guide Products templates. Such modifications, at the agencies’ discretion, may be made, resulting in “Final Agency-Specific Policies.” Such policies may be posted on the agency’s website, printed and posted in the agency’s office, and hard copies or PDFs may be provided to program applicants and participants, HUD employees and other auditors, management agents, and other affiliated entities with a program-related need to view agency policies. Under no circumstances may NMA Model Policies and Guide Products be used by other entities who are not housing providers or affiliated entities to develop consulting or training products which are represented as the intellectual property of said entity. Any unauthorized reproduction, distribution, modification, or creation of derivative works from the Content without express written permission from Nan McKay and Associates is strictly prohibited.
Model Forms: The Purchasing Agency may alter model forms and make unlimited copies for use with program applicants and participants only.
PIH Alerts: The Purchasing Agency may forward PIH Alerts within the agency only and/or PIH Alerts may be placed on a password or otherwise secured agency shared drives or intranet sites.
Video Products: The Purchasing Agency may place videos on the agency’s website or YouTube channel (or similar platform) only in a manner that restricts access to agency personnel or program applicants and participants only, such as by password protection, a secured link, or other effective means. Under no circumstances may Video Products be distributed to third parties, placed or posted in a manner allowing public or unrestricted access.
Handbooks: Handbooks, in the paper format originally purchased from NMA and never a copy or digital format, may be distributed to program applicants and participants. Handbooks may be modified by adding the agency logo at an additional cost.
Master Books: The Purchasing Agency may forward Master Books within the agency only and/or may place Master Books on a password-protected or otherwise secured agency shared drive or intranet sites.

TRAINING SEMINARS

NMA training seminars are courses held live online or in person under the guidance of an NMA trainer. By purchasing or participating in an NMA training seminar, you agree to abide by our terms of use regarding training seminars.

NMA reserves the right to change trainers or cancel a seminar at any time. If a seminar is cancelled by NMA, registration fees will be refunded or credited in full. NMA is not responsible for airfare, lodging, or other travel related expenses.

Registration

You may register for training seminars using one of the following methods: credit card, check, or purchase order (subject to credit approval). To register using a credit card or purchase order, place your order through the online store, email sales@nanmckay.com with your order, or fax a completed registration form to 619.258.5791. Make checks payable to Nan McKay and Associates, and mail with the registration form(s) to 1810 Gillespie Way, Ste. 202, El Cajon, CA 92020. Payment must be received before registration can be confirmed.

For your convenience, NMA may reserve a block of discounted rooms at the hotel where an NMA-sponsored training seminar is occurring. These rooms are available upon request and may be available up to 30 days prior to the seminar. Hotels may also offer an airport shuttle for your convenience. NMA cannot guarantee any hotel services or availability.

Attendance

If you are unable to attend a training seminar you have registered for, you may send a substitute or receive a credit toward a future training, to be attended within a one-year period. If you are unable to attend, you must notify NMA in writing via email at least 60 days prior to the start date of the seminar to receive a refund. If you do not notify NMA in writing, you are responsible for the entire registration fee. If you cancel less than 60 days prior to the start of the seminar, a cancellation fee of $150 will be assessed. Substitutions must be received in writing via email on company letterhead with the seminar name, location, and attendee name, and be received by NMA prior to the seminar start date.

Training Materials

You may not copy, share, post, or otherwise disseminate training materials, including but not limited to posting on the internet, an internal network, a shared drive, or other publicly accessible means of access. Unauthorized distribution of NMA materials may result in the loss of your certification and/or in legal action.

Recording

Attendees are expressly prohibited from recording any NMA training, both in-person and online.

Certification Exams

Once an online exam link has been emailed to the student, the online exam is no longer refundable or transferable. If an online exam has been purchased and is no longer needed, any cancellation must be made either before the end of the seminar for which the exam was purchased, or before the online exam link has been emailed to the student.

You may not copy, share, post, or otherwise disseminate exam materials, including but not limited to posting on the internet, an internal network, a shared drive, or other publicly accessible means of access. Unauthorized distribution of NMA materials may result in the loss of your certification and/or in legal action.

Exam retake options vary depending on the seminar. You must contact NMA to find out the retake options available for an individual exam.

You have six months from the last day of your seminar to take an exam and optionally retake it twice for a total of three attempts. If you do not pass the exam by your third attempt, you must purchase and attend the seminar again to gain another three attempts.
